Sales Policies: U.S. Terms and Conditions of Sale

Applicable Law
Sales and Conditions apply to all Sales by The Company. You agree to comply with all applicable laws and regulations of the various states and of the United States. You agree and represent that you are buying for internal use only, and not for resale or export.

Changed Product
The Company reserves the right to ship the latest Product revisions or improvements available. The Company will not ship Product that is older or a previous version than the version illustrated on the website.

Delivery after Receipt of Order
Product will be shipped by common carrier unless otherwise noted by the customer when the order is placed. Product will be considered acceptable to the customer when delivery by carrier is accepted at the customer’s facility.

Leasing
The Company will be glad to assist the customer in leasing the VeinViewer by Luminetx™ . If interested in a leasing option, please select “Sales” from the menu to your left.

Limitation of Liability
The Company does not accept liability beyond the remedies set forth herein, including but not limited to any liability for Product not being available for use, lost profits, loss of business or the provision of service and support. Except as expressly provided herein, The Company will not be liable for any consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party. You agree that for any liability related to the purchase of Product, The Company is not liable or responsible for any amount of damages above the amount invoiced for the applicable Product, notwithstanding anything in this agreement to the contrary, the remedies set forth in this agreement shall apply even if such remedies fail their essential purpose.

Returns
You must contact The Company directly before you attempt to return any Product to The Company. Any Product returned without the proper Return Authorization Number clearly written on the outside of the packaging will be refused. To obtain the Return Authorization Number, please call Customer Service at . You must return Product to The Company in an appropriate shipping container that is equivalent to the original packaging. You are responsible for risk of loss, shipping and handling fees for returning or exchanging Product. Additional fees may apply. If you fail to follow the return or exchange instructions and policies provided by The Company, The Company is not responsible whatsoever for Product that is lost, damaged or modified.

Service and Support
All necessary support or service will be included at no charge with the purchase of your VeinViewer for the period of one year from the date of shipment.

Shipping
Shipping is FOB Chicago. Prepaid and additional.

Taxes; Title; Risk of Loss
Title to products passes from The Company to Customer on shipment from The Company's facility or vendor. Loss or damage that occurs during shipping by a carrier selected by The Company is The Company's responsibility. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility. You must notify The Company within 21 days of the date of your invoice or acknowledgement if you believe any part of your purchase is missing, wrong or damaged. Unless you provide The Company with a valid and correct tax exemption certificate applicable to your purchase of Product and the Product ship-to location, you are responsible for sales and other taxes associated with the order. Shipping dates are estimates only.

Limited Warranty
The VienViewer™ Imaging System carries a one year warranty from the date of purchase on workmanship and all defects of materials. Should your Product prove to have such defects within one year of shipment, The Company will repair or replace the product or component without charge to the owner. The Company reserves the right to determine cause of defect and how any such defect will be remedied. Warranty does not include equipment subject to misuse or accidental damage.
